This is why Cholendra cannot return to Supreme Court
KATHMANDU, Sept 18: With the end of tenure of parliament, the impeachment registered against the suspended Chief Justice Cholendra Shumsher JB Rana has fallen into limbo.
With the end of the tenure of parliament and the impeachment committee being unable to find strong bases to move the impeachment motion against Rana, many believe that Rana can return to the supreme court.
However, in a letter written by the parliamentary committee to the president’s office, office of prime minister and council of ministers, office of constitutional office, supreme court, judicial council and CJ Rana himself on Feb 13, it is mentioned that Rana cannot return to his office until the impeachment motion against him is settled.
In the letter it has been mentioned that according to the Article 101 (6) after the commencement of impeachment proceedings, the Chief Justice of Nepal or the Justice of Supreme Court, the member of the Judicial Council, the chief or official of the Constitutional Body shall not be allowed to discharge the duties of his or her office pending the settlement of such proceedings.
In this case, the proceedings of the impeachment motion registered against Rana has commenced but is yet to be finalized.
