People representatives can file their nominations for upcoming local polls only after their resignation

KATHMANDU, April 19: The Supreme Court (SC) on Tuesday scrapped a writ petition filed by people representatives demanding to scrap the Election Commission’s decision to make it mandatory for the people representatives currently holding office to resign before filing their nominations for upcoming local polls.

A joint bench of Justice Tej Bahadur KC and Til Prasad Shrestha took a decison to this effect.

With this decision, the election code of conduct issued by the poll body will be fully implemented.

The people representatives currently holding offices – who are looking forward to fielding themselves in the upcoming local polls for the next term – will now have to resign before filing their nominations, according to Bimal Poudel, spokesperson for the apex court.

Earlier, Chairman of Helambu Rural Municipality, Nima Gyalzen Sherpa had filed a writ petition against the election code of conduct issued by the poll body.
